Terms of Service

1.The agreement

These terms cover two things: your use of the commandpush.com website, and, if you subscribe, the website plan Command Push builds and runs for your business. Command Push is operated by Proverb AI Consulting, PO Box 28, Cave Creek, AZ 85327, United States. “We” and “us” mean Proverb AI Consulting. “You” means the business subscribing, and the person agreeing on its behalf confirms they have the authority to do so.

By requesting a mockup, booking a call, or paying for a plan, you agree to these terms and to our privacy policy.

2.The free mockup

The homepage mockup is free and creates no obligation on either side. You can say no and owe nothing. We can decline to produce a mockup if your business is outside the trades we serve or if we cannot do good work for you, and we will tell you if so. The mockup remains our property until you subscribe; please do not have it built elsewhere.

3.What the subscription includes

A standard plan, billed monthly, includes:

• Design and build of your website: homepage, about, contact, and up to eight service pages, written in your voice from the information you give us
• Hosting, SSL, and daily backups
• Tap-to-call and a quote form that delivers to your phone and email
• Your Google reviews displayed on the site
• Google Business Profile setup or cleanup, and the local search foundation on the site itself
• Content updates on request, typically the same business day, within reasonable use
• A monthly performance check and fixes
• Support by text and email from a real person

Additional locations, more than eight service pages, or custom features are quoted separately before any work starts. The price we quote is the price you pay.

4.What it does not include

• Paid advertising or ad management
• Logo design beyond a clean text wordmark if you have no logo
• Photography, though we will tell you what to shoot
• Third-party fees such as your domain registration or scheduling software
• Copywriting or features unrelated to your website

5.Payment

Plans are billed monthly in advance by card. Your first payment is due when you approve the mockup and ask us to build, and it covers the first month. There is no separate build fee for a standard plan. Payments are non-refundable except where the law requires otherwise or where we have failed to deliver what these terms promise.

If a payment fails, we will let you know and retry. If it remains unpaid 14 days after the due date, we may suspend the site until it is paid. If it remains unpaid 30 days after the due date, we may treat the plan as cancelled.

We may change the monthly price with at least 30 days' written notice. If you do not want the new price, you can cancel before it takes effect.

6.Cancellation

There is no contract term. Cancel any month by emailing us. Your plan ends at the end of the billing month you are in, and the site comes down at that point. There is no cancellation fee.

When you leave, your domain stays yours. We will point it wherever you ask and send you your written content and photos. The site design and code are ours and are not transferred, though you are free to have another provider rebuild the site.

7.Your responsibilities

• Give us accurate information about your business, licenses, insurance, services, and service area, and tell us when any of it changes
• Only give us logos, photos, and text you have the right to use, and confirm any reviews we display are genuine
• Review the site before launch and respond to approval requests within a reasonable time
• Keep your domain registration current and give us the access we need to connect it
• Not use the site for anything unlawful, misleading, or outside your licensed trade

You are responsible for the accuracy of claims on your site, including licensing, insurance, pricing, and guarantees to your customers.

8.Who owns what

• Yours: your business name, logo, photos, reviews, your domain, and the written content about your business. You give us a license to use these to build and run your site.
• Ours: the site design, code, templates, and tools we use to build and run it. You have a license to use them as part of your site while subscribed.

9.Showing our work

We may show your live site, with your business name, as an example of our work on our website and in sales conversations. If you would rather we did not, email us and we will stop. We will never invent reviews or results for you, and we will not share your leads or private business information.

10.No guarantees of results

We build sites the way Google and customers respond to, and we keep them working. We cannot promise a particular search ranking, a number of calls, or an amount of revenue. Google changes, competitors change, and seasons change. What we promise is the work described in these terms, done well, every month you subscribe.

We aim for the site to be available at all times but cannot guarantee it. Hosting, domain, and email providers occasionally fail. We will fix what is in our control promptly.

11.Limitation of liability

To the fullest extent the law allows, our total liability to you for anything arising out of these terms or your site is limited to the amount you paid us in the three months before the claim. We are not liable for lost profits, lost business, or indirect or consequential damages. Nothing in these terms limits liability that cannot be limited by law.

12.Indemnity

You agree to cover us for claims arising from content you provided, claims you make to your customers, or your use of the site in breach of these terms, including reasonable legal costs.

13.Termination by us

We may end your plan with 30 days' written notice for any reason, in which case we will refund any prepaid days past the end date and help you move. We may end it immediately if you breach these terms, use the site unlawfully, or fail to pay as described above.

14.Governing law and disputes

These terms are governed by the laws of the State of Arizona. If there is a problem, email us first and we will work to resolve it directly. Any dispute that cannot be resolved that way will be handled in the state or federal courts located in Maricopa County, Arizona, and you agree to that venue.

15.Changes

If we change these terms we will update the effective date above and notify subscribers by email at least 30 days before material changes take effect. Continuing to subscribe after that date means you accept the new terms.
